1. Acceptance of these Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

2. Eligibility

You must be at least 13 years old to use the Service. Where local law sets a higher age of digital consent (such as 16 in parts of the EEA), you must meet that age or use the Service with the consent and involvement of a parent or guardian. By using the Service you represent that you meet these requirements.

3. Your account

• You are responsible for the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• Notify us promptly at support@hskuniversity.com if you suspect unauthorized use of your account.
• You may not share, sell, or transfer your account, or create an account using false information.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Copy, scrape, resell, or redistribute the Service's content except as expressly permitted.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems.
• Abuse, harass, threaten, or harm other users, or post unlawful, hateful, or infringing content.
• Use bots or automated means to access the Service in a way that harms it or other users.
• Misuse AI features to generate unlawful, harmful, or abusive content.

5. Subscriptions, billing & cancellation

The Service offers a free tier and optional paid subscriptions (such as HSK Pro, HSK Max, and HSK Ultra) billed monthly, quarterly, or yearly. Subscription payments are processed by LemonSqueezy, which acts as Merchant of Record; tutor sessions and account top-ups are processed by Stripe. Your purchases are also subject to those providers' terms at checkout.

• Auto-renewal: paid subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before renewal.
• Cancellation: you can cancel at any time. Cancellation stops future renewals; your paid access continues until the end of the current billing period.
• Refunds: we don't operate a general or automatic refund policy, and payments are not usually refundable for partial or unused periods. However, if something goes wrong because of a problem or mistake on our side — such as a billing error or a service fault — contact support@hskuniversity.com and we'll make it right, including a refund where appropriate. Refunds are also subject to our payment providers' processes.
• Price changes: we may change subscription prices; changes apply to future billing periods and we will give notice where required.

Tutors and bookings. The Service may let you book sessions with tutors who are independent third parties. We provide the platform and facilitate payment (via Stripe) but are not responsible for the conduct, quality, or availability of individual tutors. Bookings, cancellations, and any tutor-specific terms are subject to the details shown at the time of booking.

6. Your content

You retain ownership of the content you submit (for example, community posts, messages, and profile details) ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and use it as needed to operate and improve the Service. You are responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or the law. We may remove content or suspend accounts that violate these Terms.

7. AI features

The Service includes AI-powered features (such as the AI tutor, AI chat, and voice tutor). AI-generated responses may be inaccurate, incomplete, or inappropriate, and are provided for learning and practice only — they are not professional, legal, medical, or financial advice. Always verify important information independently. We are not responsible for decisions you make based on AI output.

8. Our intellectual property

The Service, including its lessons, curriculum, software, design, text, graphics, and logos, is owned by HSK University or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for your own learning. You may not reproduce, distribute, or create derivative works from our content without our permission, except as the law allows.

9. Third-party services

The Service relies on third-party providers (including Google Firebase, Google Vertex AI, Google reCAPTCHA, ElevenLabs, LemonSqueezy, Stripe, Resend, and analytics/monitoring providers such as PostHog and Sentry) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them may be subject to their own terms and policies.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any exam result or learning outcome will be achieved.

11. Limitation of liability

To the maximum extent permitted by law, HSK Digital LLC and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

12. Indemnification

You agree to indemnify and hold harmless HSK Digital LLC and its owners, employees, and providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or the law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us or others. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction, unless mandatory local consumer law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
